Bankruptcy Chapters

Most people think of bankruptcy as a process in which you go to court and get your debts erased. But in fact, there are two types of bankruptcies: the more familiar liquidation bankruptcy, where your debts are wiped out completely (Chapter 7 bankruptcy) and reorganization bankruptcy, where you partially or fully repay your debts. (Chapter 13 bankruptcy.)

Chapter 7

Your unsecured dischargeable obligations will be canceled and wiped away in a Chapter 7, allowing you to actually "start over" debt-free! Credit cards, medical bills, personal loans, and department store charges  can be discharged in an Amarillo Chapter 7 bankruptcy. Vehicle loans and mortgages can be handled in one of two ways: you can maintain the collateral, such as your car or home, and pay the obligation as if you hadn't filed bankruptcy, or you can surrender the collateral and have the debt discharged.  The choice is up to you.

See our Chapter 7 bankruptcy page for more information.

Chapter 13

Individuals can use Chapter 13 to reorganize their debts. When you file Chapter 13 bankruptcy in Amarillo, your debts are consolidated and lowered to a single monthly payment that you can manage based on your monthly disposable income, while allowing you to catch up on any missed payments on your home or vehicle while retaining your home or vehicle. The best part is that a Chapter 13 bankruptcy will prohibit your house from being foreclosed on and allow you to catch up on your back payments over the course of 3 to 5 years. Your unsecured obligations, such as credit cards, medical bills, and personal loans, are paid depending on what you can afford after you've paid off everything else, which for most people in Amarillo is close to zero. The leftover balance is then discharged and completely erased!   Chapter 13 is not available to partnerships or corporations. But a person who has a small unincorporated business may file Chapter 13 bankruptcy. Before you file for Chapter 13 bankruptcy, it’s important to discuss your particular financial situation with an experienced Amarillo bankruptcy attorney to make sure it’s the best legal option for your needs.
